DUI COURT
Misdemeanor DUI cases that occur within the city limits are prosecuted in Municipal Court.
The first arraignment date is known as a (plea date). Defendants either enter a plea of Guilty or Not Guilty. Guilty cases will be sentenced the same day, and Not Guilty cases will be given the opportunity to discuss the case with a City Prosecutor. If no resolution, the case will be set for Trial on another day with all parties involved present and prepared for Trial.
Fines for DUI offenses are as follows:
DUI First Offense and conviction (where intoxilyzer test was given):

$250.00 to $l,000.00 or no more than forty-eight (48) hours in jail or both: and will be ordered to attend and complete the Mississippi Alcohol Safety Education Program (M.A.S.E.P.) and Victim Impact Panel (V.I.P.).

The Mississippi Department of Public Safety will suspend drivers license for one (1) year which will be reduced to (90) days if (M.A.S.E.P.) is completed.
DUI Second Offenses and conviction (where intoxilyzer test was given) if the offense is within five (5) years:

$600.00 to $l,500.00 fine and not less than five (5) days in jail no more than one (1) year in jail, and immobilization of any and all vehicles registered to the person convicted for the entire length of license suspension.

The Mississippi Department of Public Safety will suspend drivers license for a period of two (2) years. Suspension may be reduced to one (1) year if a Drug and Alcohol assessment course by a State Mental Health Center is completed.
DUI Third Offense or subsequent offense and conviction if the offense is within five (5) years (where intoxilyzer test was given) is a Felony, which will be handled through Circuit Court.
All M.A.S.E.P. and V.I.P. forms for registration will be provided on same day of sentencing.
