Courthouse Road Improvements Project Announcement

Attention Courthouse Rd Businesses & Residents

                                                Courthouse Road Improvements Project Announcement

October 12, 2018

Dear Property Owner or Resident:

As you are aware, Jay Bearden Construction, Inc. began construction of the Courthouse Road Improvements Project on June 26, 2017.  The project had an initial schedule to allow for 211 production (“working”) days.  During the project, underground conduit for future rerouting of overhead utilities was added to this contract at the request of the business owners and residents of Courthouse Road.  Currently, a contract extension to allow for an additional 40 working days related to installation of this conduit is being considered; if approved, this would extend the contract time to 251 working days.

As of today, this project has extended beyond its proposed schedule. The 211th working day of this contract was July 25, 2018.  Additionally, if the extension is approved as drafted, the 251st working day would have expired as of September 19, 2018.   As per contract documents, should the contractor not complete the construction within the original time or the time as extended, Jay Bearden Construction, Inc. will pay a daily charge of $830 per calendar day following the contract expiration date.  These “liquidated damages” are assessed against the contractor’s applications for payment.  While the contractor could make additional requests for the extension of contract time, these requests would require both City of Gulfport and Mississippi Department of Transportation review and acceptance.

Given the overrun in contract time, the City has requested an updated project schedule from Jay Bearden Construction, Inc. The latest schedule provided by the Contractor has construction completing by Thanksgiving (November 22nd) (as shown on the back of this page).  Completion of major milestones are as follows:

Storm Drainage – complete on or before 10/31/18

  • Curbing – complete on or before 11/05/18
  • Underground Electrical Conduit – complete on or before 10/12/18
  • Site Lighting – construction to be complete on or before 10/22/18
  • Sidewalks – complete on or before 11/15/18
  • Site Paving – complete on or before 11/22/18

The City of Gulfport will continue to monitor the contractor’s progression versus the schedule they provided. We appreciate your patience as we work with the contractor to finalize this project.  If you have any questions or comments, feel free to contact Andy Phelan, P.E., with Pickering Firm, Inc. by email (preferred) at aphelan@pickeringfirm.com or by phone at 228-432-5925.

Thank you for your cooperation as we continue our efforts to improve the City of Gulfport.

Have a Great Mississippi Gulf Coast Day!
