There came on for consideration at
a duly constituted meeting of the Mayor and Members of the City Council of the
City of Gulfport, Mississippi, held on the 6th day of April, 2010,
the following Ordinance:
AN ORDINANCE
AMENDING SECTIONS 11-64(d)(1); 11-64(e);
AND 11-66-(e)(1)(a)
OF THE CODE OF ORDINANCES OF
THE CITY OF
GULFPORT, MISSISSIPPI
WHEREAS,
the Gulfport City Council has enacted various ordinances over time
regulating water and sewers in the City of Gulfport and the rates to be charged
by the City of Gulfport for water, sewer collection, sewer treatment and
wastewater debt, as well as various charges for services related to water and
sewers in the City of Gulfport, which ordinances have been codified as Chapter
11, Articles I, II, III, IV, V, and VI of the Code of Ordinances of the City of
Gulfport, Mississippi; and
WHEREAS,
certain sections contained within Chapter 11, Article III, which regulate the
fees charged for various services related to water and sewers in the City of
Gulfport are in need of amendment for purposes of increasing the feeds charged
for water and sewer taps and for other purposes.
NOW,
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GULFPORT,
MISSISSIPPI, AS FOLLOWS:
SECTION
1. That the matters and things
set forth in the above preamble are hereby accepted as stated as the findings
of the Gulfport City Council.
SECTION
2. That Chapter 11, Article III,
Section 11-64 (d) (1), of the Code of Ordinances of the City of Gulfport,
Mississippi, is hereby amended to read as follows:
(d) Water taps. The charges for residential and commercial water taps shall be as follows:
(1) For taps of the following sizes/types, there shall be a flat rate charge as specified:

SECTION 3. That Chapter 11, Article III, Section 11-64 (e), last two sentences, of the Code of Ordinances of the City of Gulfport, Mississippi, are hereby deleted and the following shall be inserted in their place:
This exemption shall expire two (2) years after final acceptance by the City. Where this exemption applies and the city is required only to install any/all meters in the subdivision, the charge for such meter installation shall be as follows:

In addition, where the City extends water service to
previously unserved areas of the City, owners of real property located in the
previously unserved area that are required, by Ordinance, to connect to the
Citys water system and upon which a residential structure exists on the day
that water service is first provided to the previously unserved area shall be required
to pay only the meter installation charge set forth above.
SECTION 3. That
Chapter 11, Article III, Section 11-66 (e) (1) (a) of the Code of Ordinances of
the City of Gulfport, Mississippi, is hereby amended to read as follows:
(e)
Sewer
tapping charge: The charges
for sewer taps shall be as follows:
(1) a. Owners shall pay tapping fees in accordance
with the following schedule:
1. Single
family dwelling, per unit $700.00
2. Apartment
complexes, per unit 450.00
3. Condominiums,
per unit 450.00
4. Mobile home
park, per unit 450.00
5. Motel
units, per unit 450.00
6. Recreational
vehicle parks, per unit 300.00
7.
Commercial projects, per fixture 75.00
8.
Restaurants, per square foot gross floor area 0.45
9.
Laundries, per machine 150.00
SECTION 4. All provisions of Chapter 11 of the
Code of Ordinances of the City of Gulfport, Mississippi, not in conflict
herewith shall remain in full force and effect as heretofore provided.
SECTION
5. This Ordinance shall be in full
force and effect thirty (30) days after the date of passage. It shall be published according to law and
shall be spread on the minutes of the Gulfport City Council.
The above and foregoing Ordinance,
after having been first reduced to writing and read by the Clerk, was
introduced by Councilmember Walker, seconded by Councilmember Pucheu, and was
adopted by the following roll call vote:
